The terms and conditions of this online store comply with the provisions of Government Emergency Ordinance (OUG) 34/2014 on consumer rights in contracts concluded with professionals, Government Ordinance (OG) 21/1992 on consumer protection, OUG 140/2021 on certain aspects concerning sales contracts for goods (warranties), OG 99/2000 on the marketing of products and market services, Law 363/2007 on combating unfair commercial practices, etc. These legal acts apply to consumers, as well as the specific legislation governing the products sold.
We undertake all professional diligence to ensure the accuracy of the information on this online store regarding the essential characteristics of the products, quantitative and qualitative characteristics (including prices and stock). All information presented on this online store is offered in good faith. Our company is not obliged to confirm an order at a derisory price or a price significantly lower than the real price practiced for a product, due to the prohibition of selling products below the purchase price, except under the conditions provided by law.
Although most of the products displayed on our website are in stock, if the products you ordered are not in stock, we will contact you as soon as possible (by phone or email) to inform you of the possibility of updating the order (modifying/updating product characteristics), including updating shipping/delivery costs (as applicable), so that you have the right to accept or refuse the modified/updated price offer.
DEFINITIONS
Client – a legal or natural person (consumer) over 18 years of age who views the pages of this online store and who places an Order/purchases one or more products.
Order – an electronic document by which communication between the client and the seller is carried out, through which the seller agrees to deliver the products, and the client agrees to receive these products and make payment according to the details established prior to delivery.
Product – any goods on this online store, mentioned in the order and to be supplied by the seller to the client.
Moment of concluding the distance contract – the moment when the seller confirms, on a durable medium (e.g., email), acceptance of the order, namely confirmation of stock availability and the commitment to transfer ownership of the products to the buyer and, implicitly, issuance of the tax invoice (order confirmation).
Account – the section of the online store consisting of identification data (first and last name), email address, and a password that allows the Buyer to submit the Order and which contains information about the Client/Consumer and their history on the Site (Orders, invoices, product warranties, etc.). The user is responsible for ensuring that all information entered when creating the Account is correct, complete, and up to date.
Commercial Communications – any type of message sent (such as email/SMS/phone/mobile) containing general and thematic information, information about products similar or complementary to those you have purchased, information regarding offers or promotions, information regarding Goods and Services added to the “Account/My Cart” section or the “Account/Favorites” section, as well as other commercial communications such as market research and opinion polls.
Transaction – the receipt or refund of an amount resulting from the sale of a Good by the seller to the consumer, using the services of the payment processor agreed by the Seller, regardless of the delivery method.
Review – a personal opinion in the form of text and a rating defined by a number of stars from 0 to 5, awarded by a user or a buyer who has purchased and used a product presented on the website and representing an assessment written based on their personal experience and ability to provide qualitative comments.
English phrases – Words used as such in English, without the intention of misleading the consumer, because a literal translation of that expression from English into Romanian does not always convey the original meaning, as each language has distinct cultural and idiomatic nuances (e.g., full spectrum, etc.).
TERMS (TIME LIMITS)
All time limits are interpreted as calendar days, except for explicit mentions of “working days.” If a period expressed in days is calculated from the moment an event occurs or an act is performed, the day on which the event occurred or the act was performed is not counted. If the last day of the period is a non-working day, our company will appropriately extend the period.
PRICES AND PAYMENTS
All prices displayed on the online store are final prices and include VAT. Prices are displayed on the product pages, at the checkout of the ordering process, as well as in the orders section available in the Client account. At the time of completing the order process, you will be informed of the final price you must pay for your order. The final price will be communicated to you before you accept the order. The prices of Goods do not include shipping/delivery, which is displayed separately, according to the dedicated SHIPPING section, since the shipping price varies depending on the size and weight of the products. We will issue a tax invoice for the Products delivered according to the Order; your obligation is to provide correctly and completely all information necessary for issuing the tax invoice, in accordance with applicable law.
PRICE REDUCTIONS / VOUCHERS
Our online store may occasionally offer contests or discount/promotion campaigns for its products, which will be clearly indicated in the product description and/or in the specific Regulations section or through specific banners. Vouchers and other loyalty methods are non-transferable, cannot be combined, and cannot be used for products that already benefit from price reductions. Promotions do not cumulate unless explicitly specified.

- Cash on delivery (COD): You can pay directly to the courier when the products arrive at your address or when you pick them up from the courier company’s office (Sameday Courier, Fan Courier, etc.).

PLACING THE ORDER
The first step is to view the products displayed in the online store. After you find the desired product(s), select the product and the number of units, then click the “Add to cart” button. You can view your cart at any time by accessing the link at the top-right of the site, which shows you the number of products in the cart and their total value. To finalize the order, you must provide your data and delivery address in the order form. If you have already shopped with us and have an account, simply enter the email address you registered with and the password you used.
To place an order on www.medicanah.com, it is not mandatory to create an account, although we encourage this. Fill in the fields in the form and follow the instructions. We recommend using a valid email address that you use frequently. Your invoice will be found in your client account and can be downloaded from there. If you choose not to access the account, you can find the invoice in the email you provided. After logging in or registering, check your cart and the address to which you want the order shipped. Then choose the payment method and click the “Place order” button.
After your order has been submitted, you will receive an email confirming receipt of the order as soon as possible. If you do not receive this email, please contact us. After verifying your order and to eliminate any errors, we will send you another email to confirm the order or we will contact you to confirm the order or to make modifications/updates (as applicable). In some situations, you may receive a confirmation email immediately after placing the order. Your order becomes valid from the moment we accept/confirm it (order confirmation email).
Although most of the products displayed on our website are in stock, if the product you ordered is not in stock, we will contact you as soon as possible (by phone or email). For this reason, we recommend that before ordering a product you check stock availability, since products that are not currently in stock cannot be delivered within the standard delivery time. Depending on the new information provided, you can decide to cancel the order (we will immediately refund any amount paid by you) or accept an extension of the delivery time.
ASPECTS REGARDING THE MOMENT OF CONCLUDING THE DISTANCE CONTRACT
A distance sales contract is any contract concluded between the online store (seller) and the consumer without their simultaneous physical presence, using exclusively one or more distance communication means up to and including the moment when the contract is concluded (confirmation of order acceptance by the online store), under which the seller undertakes to transfer or transfers ownership of certain products/goods to the consumer (e.g., order confirmation represents the online store’s acceptance to transfer ownership of the products to the consumer).
The email message informing you that the order has been received or regarding the status of your order does not constitute a contractual obligation on our part but is a communication made by electronic means. Any order received will go through a prior process of verification of stock, product characteristics, and prices, and the seller’s commitment to transfer ownership of the products—and hence the contractual obligation—begins at the moment of order confirmation.

Estimated/standard delivery of products can be made within a minimum interval of 24 hours and a maximum of 48 hours from the moment all order details have been validated (payment method, delivery time, stock, prices) and/or from the moment payment has been made—in the case of payment in advance (bank transfer, wire transfer, cash advance).

INTERNATIONAL EXPRESS COURIER DELIVERY IN 3–7 DAYS
Shipping is FREE for all orders over 500 Lei (100 EUR)! For orders under 500 Lei, the shipping cost is 75 Lei (15 EUR).
The tax invoice will be issued in electronic format and can be used in accounting, having fiscal value, according to Law L260/2007 regarding the recording of commercial operations by electronic means. Upon your request, an invoice can also be issued on paper.
The usual delivery time for products purchased from our online store that are in stock is 1–2 days from the moment the order is registered, while for those out of stock or brought in only by special order it is 7–14 days. In special conditions, medicanah.com reserves the right to extend the delivery time, with prior notice to the person who placed the order.
In exceptional situations such as: a state of emergency, unfavorable weather conditions, road blockages and accidents, or other special situations such as peak shopping periods (e.g., Black Friday, Christmas, Easter), which strictly concern the courier’s/carrier’s operating schedule, or the seller’s technical problems, delivery intervals may be delayed; however, the maximum delivery time cannot exceed 30 calendar days. If the seller does not fulfill their contractual obligations because the specified product is not delivered within a maximum of 30 days, they will immediately inform the Buyer and refund the amount paid by the Consumer. The delivery time for products made to order may vary case by case and will be communicated to the client when the order is placed or before confirming it on a durable medium.
Check the integrity of the parcel in the presence of the courier who delivered it. Only in this way can compensation be claimed for damage caused during transport! Please do not accept visibly damaged or broken parcels from the carrier—with cut, torn, or missing wrapping—without notifying one of our sales operators.
The Seller also offers the possibility of shipping products with the option to open the parcel upon delivery (optional, for a fee) and to visually check whether the products or their packaging are appropriate; technical checking/testing at the destination is not permitted. We recommend taking photos of the product packaging at the time and place of delivery, as well as of the products, as applicable.
The products are new and are properly and adequately packaged by the manufacturers, the primary packaging being perfectly sized to the products they contain, so that there is no risk of mechanical shock caused by the product’s packaging. In this sense, the only damages can be caused by improper transport and handling of the product by the courier up to your location or by you or persons designated by you (third party) from the location to your apartment.
Please note that the risk of damage to the goods transfers to you when you or a third party designated by you, other than the carrier, takes physical possession of the goods, i.e., when the product receipt document is signed.
Thus, when taking possession of the product, it is expressly recommended that you immediately inspect the parcel—preferably in front of the courier (checking the parcel, packaging, product, as applicable)—take photos of the packaging and, if any damage to products or packaging is found, you are obliged to request the drawing up of a report noting the defect/damage or to mention these aspects to the courier in writing.
In the event of any damage or defect, you are not obliged to accept the parcel. Claims related to damage caused during transport are accepted only at the time the parcel arrives. From the moment you take possession of the product, you are responsible for its quality, integrity, and functionality.
LEGAL RIGHT OF WITHDRAWAL
You benefit from a period of 14 calendar days from the moment you receive the product to determine the nature, characteristics, and functionality of the product, as you would if you purchased a product from a physical store. Given the specifics of the products sold on www.medicanah.com, determining the nature and characteristics of the products, as well as their functionality, can be done visually and technically without using them for purposes other than these. You may check the integrity of the products, labels, and seals of the packaging, etc., but you may not use/wear the products. If you are still not satisfied with the product, you have the right to withdraw from a distance contract without having to justify your decision to withdraw.
Thus, you can exercise the right of withdrawal through a clear declaration to this effect (e.g., email to the online store’s contact details, through your client account, as applicable, or through the withdrawal form) sent within a maximum of 14 days from the date you took possession of the product. After notifying the declaration of withdrawal, you will contact a courier company to send the returned product, or, as applicable, we will make a pickup/return request so that, in the following days, a courier will come to your address to collect the product.
You must return the product (and any gifts that accompanied that product, as applicable) within no more than 14 days from the date you informed us of your decision to withdraw from the contract, and you will be charged the cost of returning the product; the Seller does not undertake to bear this cost.
Products must be returned intact and without signs of use/wear, as well as in the original, undamaged/undeteriorated packaging. Protective films applied to the product, where present, should be removed only if strictly necessary to test it.
The risk of deterioration transfers to you at the time the goods are handed over to the carrier if the carrier was entrusted by you to transport the goods and this option was not offered by our company, without prejudice to your consumer rights against the carrier/courier.
We will refund all amounts we have received as payment from you (including shipping if this service was paid to our company) within a maximum of 14 days from the date you informed us of your decision to withdraw or no later than when we take possession of the returned product (provided that, upon inspection, the product is not subject to value reduction caused by use/wear), using the same means of payment as those used by you for the initial transaction, unless you have agreed to another means of payment and provided that no fees fall to you as a result of the refund. If, under a single order, you requested several products that are delivered separately, you may exercise the right of withdrawal within 14 days, which will be calculated from receipt of the last product delivered.
Consumer responsibility for improper USE of goods
During the 14 days, you as a consumer may “determine the nature, characteristics, and functioning of the goods” without using or wearing the products, exactly as you would in a physical store, and you are responsible for the decrease in value of the goods if you use/wear the products.
You may open the packaging to access its contents if similar goods are commonly displayed unwrapped in specialized stores. In this sense, damage to the packaging only by simply opening it is not a reason for reducing the product’s value. Therefore, during the withdrawal period, you must handle the opening of the goods’ packaging with the necessary care without damaging it. However, returning products without the original packaging or with abnormal degradation of the packaging, as well as with protective films applied to the item removed (where applicable), may be considered damage/destruction of the goods caused by transporting the product in unsafe conditions—transport which is your responsibility.
Value reduction of products
If the goods purchased and returned have been used by you to an extent that exceeds what is necessary to establish their nature, characteristics, and mode of operation—meaning the products are returned worn/used/damaged/destroyed, etc.—the right of withdrawal is not excluded; however, you will be liable for any reduction in the value of the goods. This is assessed by our company on a case-by-case basis based on a justificatory document of value reduction and may vary as a percentage of the amount you paid; consequently, a smaller amount than what you paid may be refunded to you.
The decrease in the value of goods may consist of costs of cleaning, repair, replacement of parts or addition of accessories, etc., to bring the products to their initial condition, where such costs are not disproportionate for the seller in relation to the nature of the wear of the products. If such goods can no longer be sold as new, they will be sold as second-hand goods at a significantly lower price, in which case the reduction in value will consist of objectively justified loss of income for our company.
If the consumer’s testing of the goods has exceeded what is necessary to establish their nature, the characteristics and functioning of the goods, as well as the level of wear or the state of conformity of the product, are assessed on a case-by-case basis, and the value reduction may vary from case to case and may be considerable in certain situations (the percentage of reduction may be over 50% of the value of the good). Comparison with what a consumer can normally do in a physical store/showroom before purchasing a product serves as a good point of reference.

Exceptions from the LEGAL right of withdrawal
In accordance with legal provisions, certain products and situations are excepted from return, including “goods made to the consumer’s specifications or clearly personalized.” In addition, since consumer safety and the prevention of health or hygiene risks must be maintained, the legislation provides that the following are also excepted from return: “goods liable to deteriorate or expire rapidly and sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed by the consumer.” Please consult the return policy to find out which products and situations are not eligible for the 14-day right of return.
SPECIFIC ASPECTS REGARDING MADE-TO-ORDER PRODUCTS (NOT IN STOCK)
Orders for products that are not in stock are NOT considered distance contracts since they may be subject to requests for quotes and separate contracts concluded by electronic means used to process, store, or transmit information. Made-to-order products have specific characteristics, may be customized, may benefit from personalized price offers, etc., and may have delivery times that vary significantly—sometimes over 30 days—since the products are imported from numerous international suppliers. Please contact us with an exact request (request for quote) for the desired products and we will reply as soon as possible and send you a customized offer. These orders will be the subject of a separate product supply contract communicated to you by electronic means (e.g., email) and agreed by both parties.
INTELLECTUAL PROPERTY RIGHT / COPYRIGHT
The Seller is the owner and operator of the website www.medicanah.com and owner of the registered trademark of the same name. Any use and/or reproduction, in any form and for any purpose, of the materials published on the site (including the name, design, logo, and site structure, product images, and texts), without the prior consent of the seller, is prohibited and will be sanctioned according to the Romanian legislation in force regarding intellectual property rights. The content of this online store—including but not limited to logos, stylized representations, commercial symbols, static images, dynamic images, text and/or multimedia content presented on the Site—is the exclusive property of the seller, who reserves all rights obtained in this respect, directly or indirectly (through licenses to use and/or publish). Reports of possible copyright infringements should be sent to the email address in the contact section.
The Client/User is not permitted to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, link to, display, include any content in any context other than the original one intended by medicanah.com, include any content outside the medicanah.com site, remove the copyright markings of medicanah.com on the content, as well as participate in the transfer, sale, or distribution of materials produced by reproducing, modifying, or displaying content, except with the express consent of medicanah.com.
If medicanah.com grants the Client the right to use certain content under a separate usage agreement, to which the Client has or obtains access under this agreement, this right extends only to that content defined in the agreement, only for the period of this content’s existence on the site or for the period defined in the agreement, according to the defined conditions (if they exist), and does not constitute a contractual commitment by medicanah.com to the respective Client or any other third party who has/obtains access to this transferred content by any means and who could be or is harmed in any way by such content during or after the expiration of the usage agreement.
No content transmitted to the Client/Consumer by any means of communication (electronic, telephone, etc.) or obtained by accessing, visiting and/or viewing constitutes a contractual obligation on the part of medicanah.com and/or the employee or collaborator of medicanah.com who mediated the content transfer, if such exists, with respect to the respective content. Any use of the Content for purposes other than those expressly permitted by this document or the usage agreement accompanying it (if any) is prohibited.
Reviews
The Seller allows the posting of reviews in the online store and provides everyone access to customer reviews regarding products, but does not guarantee that they come only from customers who have purchased or used/consumed the product. Reviews are analyzed before being accepted and posted to prevent the use of offensive or abusive words.
WARRANTIES
Conformity warranty (2 years)
The warranty is offered by our company as seller in accordance with OUG 140/2021 and OG 21/1992 (r2), legal acts intended for natural-person clients and within Romania. Finding non-conformities and ensuring the warranty are our responsibility. The conformity warranty for new goods (durable goods) is granted to consumers for a period of 2 years from delivery, and for a second-hand/resealed good for 1 year. In the case of legal entities, the conformity warranty offered is 1 year and is granted according to Articles 1707–1718 of the Civil Code. The warranty does not apply to consumables/accessories which by their nature cannot benefit from a warranty.
Ways to ensure the conformity warranty
In case of non-conformity, you benefit from the following corrective measures (in this order):
- bringing into conformity by repair;
- bringing into conformity by replacement (if the good cannot be repaired);
- proportional price reduction (if the non-conformity is minor);
- termination of the contract and refund of the value (if repair or replacement cannot be carried out).
- As a particularity, in case of non-conformity (found and confirmed by the seller) within the first 30 days from purchase, the product will be replaced directly.
We verify the reported aspects and diagnose the good to determine whether it is eligible for warranty. If the non-conformity is confirmed and remedied by repair, the warranty is extended by the downtime of the good. Bringing into conformity by repair or replacement is carried out within a maximum of 15 calendar days from the moment of notification. If the non-conformity is remedied by replacement, a new 2-year warranty term will be granted for the replaced good.

Recommendations regarding PACKAGING AND SENDING defective products
Some goods sold may be fragile; therefore, when sent for warranty service, we recommend proper packaging so that they reach us intact and safely. You are not required to keep the original packaging during the warranty period; however, we recommend that products be wrapped and packaged so that there is no possibility of them moving inside the package.
Small electronics and other accessories are fragile and must be protected against scratches and damage; therefore, they must be wrapped and packaged so that the product cannot move inside the package. Always use packaging sized to the dimensions and weight of the transported products. The goods must not move inside the box. There should be a space of 5–6 cm between the product and the walls of the box, to be filled with either wrap or polystyrene peanuts to reduce shock in case of impact.
We recommend filling empty spaces with polystyrene chips or newspaper. If several products are transported in a single box, ensure they are well separated from each other by protective packaging such as cardboard corners, polystyrene, or bubble wrap.
Recommended types of packaging:
- Pressed cardboard box filled with polystyrene chips and sealed with protective film;
- Cardboard box + bubble wrap, for protection against scratches and shocks;
- Cardboard box with 3 or 5 layers + polystyrene chips to fill empty spaces + bubble wrap for anti-shock protection;
- Cardboard box filled with polystyrene/expanded foam sheets and polystyrene chips.
Tips & Tricks
- You can wrap the product in bubble wrap for maximum protection.
- Cardboard boxes with 3 or 5 layers withstand shocks, scratches, and temperature changes.
- Bubble wrap protects against scratches and cushions shocks. It is waterproof, insulating, and recyclable. Polystyrene chips protect fragile objects by absorbing mechanical shocks and securing packed objects by preventing movement towards the box walls. Sheets, rolls, and corners made of expanded foam protect goods and cushion the impact.
- Always use packaging sized to the dimensions and weight of the transported products. The products must not move inside the box. There should be a 5–6 cm space between the product and the walls of the box, to be filled with either wrap or polystyrene chips to reduce shock in case of impact. Fill empty spaces with polystyrene chips or newspaper.
