1. Unilateral Termination of the Contract

The consumer has the right to unilaterally terminate the distance contract within 14 calendar days, without penalties and without giving any reason. The cost of returning the products shall be borne by the consumer.

The 14-day period for exercising this right starts from:

• for products, from the date of their receipt by the consumer, if the provisions of Art. 4 of Government Ordinance no. 130/2000 on the legal regime of distance contracts have been met.

If the consumer exercises the right of unilateral termination of the contract, the merchant is obliged to reimburse the amounts paid by the consumer. The reimbursement shall be made within a maximum of 30 days from the date of termination. The reimbursed amount will depend on the condition of the returned product, following an inspection.

If the product has a defect and is not covered by warranty, the consumer does not have the right to unilaterally terminate the contract within 10 working days.

2. Product Returns

The consumer has the right to notify the merchant in writing that they renounce the purchase, without penalties and without giving a reason, within 14 calendar days of receipt, according to Government Ordinance no. 130/2000.

The product may only be returned if it is in perfect condition, including packaging, accessories, and consumables, without any signs of wear or use.

3. Return Policy

According to the applicable legislation, the right of withdrawal applies only to individual customers (consumers).

Medicanah.com complies with the legislation regarding the conclusion and execution of distance contracts. According to Government Ordinance no. 130 of August 31, 2000, supplemented by Law no. 51 of January 21, 2003, approving Government Ordinance no. 130/2000:

“The consumer has the right to notify the merchant in writing that they renounce the purchase, without penalties and without giving any reason, within 14 calendar days of receiving the product.”

The returned product must be in the same condition as delivered (in the original packaging, with all accessories, intact labels, and accompanying documents). Return shipping costs are borne by the consumer, and the refund will be made within a maximum of 30 days of the return. Refunds will be made to the customer’s IBAN account or cash on delivery (at the customer’s expense).

All returned products must be:

• in perfect condition, without visible signs of use;
• with original labels and in original packaging;
• with all related accessories.

Products that CANNOT be returned:

• Products brought in on “special order” (defined as products not in usual stock but supplied based on a firm order and advance payment).
• Consumable products, e.g., CBD, CBG, CBN oils, etc.
• Products intended for oral use for health or hygiene reasons that have been unsealed by the consumer, whether used or not after unsealing.
• Products sent without a box or improperly packaged.
• Products purchased with personal pickup from headquarters.

Before sending the product, please ensure that the package has a label containing the following information:

• Sender: Full Name
• Recipient: SC Medican SRL
• Address: Strada Urusagului, Nr. 32C, Building C, Floor 2, Ap. 17 Floresti, Cluj County – Romania, 407280

If the returned product is in a condition that prevents it from being sold as new, we reserve the right to charge a fee to restore it (if possible) or to cover the price difference resulting from selling it as second-hand. Alternatively, at the customer’s option, we will reship the product at their expense. This clause applies in accordance with Government Ordinance 130/2000.

Replacement or Refund

Depending on the buyer’s choice, the money from the returned products can be used to purchase another product or refunded within a maximum of 30 days of receipt by medicanah.com, to the account indicated when completing the return form.

Products brought in on special order cannot be returned, and refunds will not be granted for them.
